1. Description of Service

BetterBizz provides tools for audio recording, AI-powered transcription, meeting summarization, meeting bot assistance, and team collaboration workspaces. We utilize third-party AI providers to process audio and generate insights.

2. User Accounts and Security

You are responsible for maintaining the confidentiality of your account credentials.

• End-to-End Encryption (E2EE): BetterBizz offers E2EE features. If enabled, you are solely responsible for securely storing your PIN and Recovery Key. If you lose both, BetterBizz cannot recover your encrypted data.
• Account Accuracy: You agree to provide accurate and complete information when creating an account.

3. Subscription, Credits, and Billing

BetterBizz operates on a credit-based system alongside subscription plans.

• Credits: Audio processing and AI tools consume credits. Unused credits roll over on paid plans unless otherwise stated for a specific offer.
• Billing: Subscriptions are billed in advance. Payments are processed securely via trusted third-party payment gateways.
• Cancellations: You may cancel at any time. Refunds are not provided for partial subscription periods.

4. Intellectual Property

Your Content: You retain all ownership rights to the content you upload. We claim no ownership over your data.

Our Service: The BetterBizz app, algorithms, and source code are the exclusive property of BetterBizz. You may not copy or modify our proprietary software.

5. User Content and Absolute Liability

By using the Service and uploading, recording, or processing any audio, video, documents, text, or URLs ("User Content"), you expressly agree to assume full and absolute legal responsibility for such content. BetterBizz acts solely as a neutral technology infrastructure provider.

• No Liability for Uploads: We do not monitor, pre-screen, or endorse User Content. BetterBizz explicitly disclaims any and all liability related to the content you upload or process, including but not limited to illegal materials, copyright or trademark infringement, confidentiality breaches, or defamatory statements.
• Consent and Lawful Recording: You represent and warrant that you have obtained all necessary, explicit consents from all participants before recording any meetings or conversations. You are entirely responsible for complying with all applicable local, state, national, and international laws regarding wiretapping, eavesdropping, and privacy.
• Prohibited Actions: You may not upload or generate content that is unlawful, abusive, highly offensive, or violates any third party's rights.

6. Indemnification

By accepting these Terms, you agree to fully indemnify, defend, and hold harmless BetterBizz, its owners, officers, employees, and agents from and against any and all claims, liabilities, damages, lawsuits, losses, or expenses (including reasonable attorneys' fees) arising out of or in any way connected with:

• Your access to or use of the Service;
• The User Content you upload, record, or process;
• Your violation of any third-party right, including intellectual property, confidentiality, or privacy rights (such as recording without consent);
• Any claim that your User Content caused damage to a third party.

7. Disclaimer of Warranties

The Service is provided on an "AS IS" and "AS AVAILABLE" basis. BetterBizz makes no warranties, express or implied, regarding the accuracy of AI transcriptions, summaries, translations, or the uninterrupted availability of the Service.

8. Limitation of Liability

To the maximum extent permitted by applicable law, BetterBizz shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising out of your use or inability to use the Service.

9. Governing Law

These Terms shall be governed and construed in accordance with the laws of the State of Wyoming, United States, without regard to its conflict of law provisions.

10. Changes to Terms

We reserve the right to modify or replace these Terms at any time. Your continued use of the Service following the posting of changes constitutes your acceptance of such changes.
